Please read these terms carefully before engaging our renovation and maintenance services.

These Terms and Conditions ("Terms") govern the relationship between you ("the Client") and Premier Renovations Group Sdn Bhd (SSM 202301045782), registered at 15A, Jalan Bukit Bintang, Bukit Bintang, 55100 Kuala Lumpur, Malaysia ("the Company", "we", "us" or "our"). By engaging our services or using the website chartpro.pro, you acknowledge that you have read, understood and agreed to be bound by these Terms.

1. Scope of Services

The Company provides residential renovation, commercial fit-out, and home maintenance services, including but not limited to kitchen remodelling, bathroom renovation, bedroom redesign, living area upgrades, interior painting, office renovation, restaurant design, retail fit-out, electrical works, plumbing, flooring installation and roofing works.

The specific scope of work for each project shall be defined in a written quotation or proposal issued by the Company and accepted by the Client. No work shall commence until both parties have agreed in writing to the scope, timeline and total cost.

2. Quotations and Estimates

All quotations issued by the Company are valid for thirty (30) calendar days from the date of issue, unless stated otherwise in writing. Quotations are based on the site conditions observed during our initial assessment and the specifications discussed with the Client.

If the Client requests changes to the agreed scope of work after a quotation has been accepted, we will issue a variation order detailing the additional cost and any impact on the project timeline. The variation order must be approved by the Client in writing before the additional work begins.

Estimates provided verbally or during preliminary discussions are indicative only and do not constitute a binding offer.

3. Acceptance and Commencement

A project is considered confirmed once the Client has signed the quotation or proposal, returned it to us and paid the required deposit as outlined in section 4 below. We will then schedule the project commencement date, taking into account material lead times, permit requirements and crew availability.

4. Payment Terms

Unless otherwise agreed in writing, the following payment structure applies:

  • Deposit: A non-refundable deposit of thirty percent (30%) of the total quoted price is due upon acceptance of the quotation. This deposit secures your project slot and covers initial material procurement.
  • Progress payment: A further forty percent (40%) is due when the project reaches the halfway milestone, as defined in the project schedule.
  • Final payment: The remaining thirty percent (30%) is due upon practical completion, once the Client has inspected the work and confirmed acceptance during the handover walkthrough.

Payments may be made by bank transfer, cheque or online transfer. All amounts are quoted in Malaysian Ringgit (RM) and are inclusive of prevailing taxes unless stated otherwise. Late payments may attract a late payment fee of one and a half percent (1.5%) per month on the outstanding balance.

5. Project Timeline and Delays

We make every reasonable effort to complete projects within the agreed timeline. However, delays may arise due to circumstances beyond our control, including adverse weather, material supply shortages, regulatory hold-ups, structural issues discovered during the course of work or changes requested by the Client.

If a delay occurs, we will notify you promptly and provide a revised timeline. Delays caused by force majeure events shall not constitute a breach of these Terms, and neither party shall be liable for losses arising from such delays.

6. Client Responsibilities

The Client agrees to:

  • Provide safe and unobstructed access to the work site at the agreed times.
  • Ensure that all necessary permissions, including landlord or management corporation approvals, are obtained before work commences.
  • Remove or protect personal belongings, furniture and valuables from the work area unless an alternative arrangement has been agreed with us.
  • Make timely decisions when input is required to avoid project delays.
  • Inform us of any known hazards, asbestos, structural weaknesses or concealed utilities at the premises.

7. Workmanship Warranty

We provide a two-year workmanship warranty on all renovation and installation work carried out by our team, commencing from the date of practical completion. During this period, if a defect in our workmanship becomes apparent under normal use, we will rectify it at no additional charge, provided the defect is not caused by misuse, negligence, unauthorised modification or normal wear and tear.

Materials and fittings supplied by the Company carry the manufacturer's original warranty. We will assist you in processing any manufacturer warranty claims, but the terms and duration of such warranties are governed by the respective manufacturer.

Materials or fixtures supplied directly by the Client ("Client-supplied materials") are not covered by our warranty. We will install such materials with the same standard of care, but we are not liable for defects inherent in the materials themselves.

8. Limitation of Liability

To the fullest extent permitted by Malaysian law, the Company's total liability to the Client for any claim arising out of or in connection with our services shall not exceed the total amount paid by the Client under the relevant quotation or contract.

The Company shall not be liable for indirect, incidental, consequential or special damages, including loss of profit, loss of business opportunity, loss of use of premises or emotional distress, except where such exclusion is prohibited by law.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Cancellation by the Client

If the Client wishes to cancel a confirmed project before work has commenced on site, the deposit paid shall be forfeited to cover administration, scheduling and material procurement costs already incurred.

If cancellation occurs after work has commenced, the Client shall pay for all work completed to date, all materials ordered or delivered, and a cancellation fee equal to fifteen percent (15%) of the remaining contract value. We will provide an itemised statement of costs within fourteen (14) business days of receiving the cancellation notice.

10. Cancellation by the Company

We reserve the right to suspend or terminate a project if the Client fails to make payments when due, refuses to provide site access, engages in abusive or threatening behaviour towards our staff, or breaches any material term of the agreement. In such cases, we will provide written notice and an opportunity to remedy the breach within seven (7) business days before exercising our right to terminate.

11. Intellectual Property

Design concepts, drawings, 3D renders and proposals prepared by the Company remain our intellectual property until full payment has been received. The Client may not reproduce, distribute or share these materials with third parties without our prior written consent. Upon full payment, the Client is granted a non-exclusive licence to use the designs solely for the purpose of the agreed project.

12. Site Photographs and Testimonials

We may wish to photograph completed projects for our portfolio, website and marketing materials. We will always seek the Client's prior consent before publishing any photographs that identify the Client's property. The Client may withdraw this consent at any time by writing to us at [email protected].

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia. In the event of any dispute arising out of or in connection with these Terms or our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice, either party may refer the matter to mediation administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur. If mediation fails, either party may pursue legal proceedings in the courts of Malaysia.

14. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the accepted quotation or proposal and any variation orders, constitute the entire agreement between the Client and the Company. They supersede all prior oral or written representations, understandings or agreements relating to the subject matter.
